Resumo: The development has always been an objective of all people and nations. Nowadays, studies about it bring the need of participation of all people and institutions in this process, which must be inclusive and include all men and the whole man. The concept of development as freedom allows a multifaceted perspective of development, tangible and practical. The development human right is recognized internationally, but brazilian rights doesn´t comtemplates it expressly as a human right, nor order how can it be claimed or affirmed. This paper aims inestigate the developlmente human right scope in brazilian law, especially in the 1988 Brazilian Republic Constitution.

Atualmente os estudos acerca do mesmo destacam a necessidade da participação de todas as pessoas e todas as instituições nesse processo, o qual deve ser inclusivo e abranger – além de todos os homens – o homem todo. O conceito de desenvolvimento como liberdade permite uma ótica multifacetada do desenvolvimento, e de prática tangível. O direito humano ao desenvolvimento é reconhecido internacionalmente, mas o ordenamento jurídico pátrio não o contempla expressamente como um direito humano, nem dispõe como o mesmo pode ser exigido ou afirmado.
