Resumo: | You can have “ access to justice “ and not have access to the process ? Although seemingly contradictory questioning , their understanding requires the revisiting the perspective of the welfare state , in line with the design of Florence and a fourth wave renewals , to finally get consistent theoretical basis with the constitutional March 1988 , the paradigm of democratic state . To do so , leaving the essential theory of the legal relationship of the process structured around the court , standing as a counterpoint to the theory of the process as adversarial procedure completed as a first step . In democratic line must ensure that the recipient of the state act is seen as co-author in the construction of this act , from the perspective of Habermas, a condition that is not met by adopting the relationist theory. |

Embora aparentemente contraditório o questionamento, sua compreensão passa pela revisitação da perspectiva do Estado Social, na linha do Projeto de Florença e de uma quarta onda renovatória, para enfim buscar bases teóricas condizentes com o marco constitucional de 1988, o paradigma de Estado Democrático de Direito. Para tanto, imprescindível abandonar a teoria da relação jurídica do processo estruturada em torno da jurisdição, colocando-se como contraponto a teoria do processo como procedimento realizado em contraditório, como primeiro passo. Na linha democrática deve-se assegurar que o destinatário do ato estatal se veja como coautor na construção deste ato, na perspectiva de Habermas, condição que não é atingida ao adotar a teoria relacionista.
