Resumo: The liberal foundations of Private Law are not suitable to answer the questions resulting from the massive increase of contractual relations. Contracts start to be directly influenced by constitutional texts and there is the recognition of the necessity to protect the consumer, the vulnerable part in contractual relations. One does not speak about contracts in terms of the supremacy of the parts’ will anymore, but in terms of the supremacy of social interests, good-faith and trust.

Os fundamentos liberais do Direito Privado são abalados na pós-modernidade com o surgimento da sociedade de consumo, e não servem para responder às questões resultantes da massificação das relações contratuais. As Constituições dos Estados tomam posição de centralidade nos ordenamentos jurídicos, os contratos passam a ter influência direta do texto constitucional, e há o reconhecimento da necessidade de proteger o consumidor, a parte vulnerável nas relações contratuais.
