Resumo: Bibliographical and documentary research, carried out in the medical and legal literature using international and national data. It investigates the validity of the construction of dogmatic and legal bases of the subject, focusing on Brazilian law. It also addresses the advance directives as the legitimate exercise of the patient's private autonomy, facing the termination of life.
