Resumo: Law 13.146 of 2015 has been praised and criticized on its doctrine within Civil Law. The law emancipated people with deficiency and made them totally capable of their acts in civil life. It is actually a rupture from the handicapped people regime, although it produced several paradoxes, such as the manner people with total lack of discernment and incapable of expressing their will may be protected. Current analysis employs the deductive method and the concepts of freedom. It provides tools that make possible such protection and provides effective freedom to people with deficiency in current society.

Es que ella emancipó la persona con deficiencia, volviéndola plenamente capaz para la práctica de actos de la vida civil. Se trata de una rotura del régimen de las incapacidades, pero que genera algunas paradojas. Entre las cuales está cómo proteger a la persona que está completamente ausente de discernimiento, no pudiendo exprimir su voluntad. Utilizándose del método deductivo y de las concepciones de libertad, el presente estudio busca instrumentos que posibiliten esta protección y que evidencien libertad efectiva de la persona con deficiencia en la sociedad actual.O advento da lei nº. 13.146/2015 recente já tem sido objeto de aplausos e críticas da doutrina mais recente do direito civil. Eis que ela emancipou a pessoa com deficiência, tornando-a plenamente capaz para prática de atos da vida civil. Trata-se de uma ruptura do regime das incapacidades, mas que gera alguns paradoxos. Dentre os quais está como proteger a pessoa que está completamente ausente de discernimento, não podendo exprimir sua vontade.
