U.S. Style Privacy and its Relationship with Brazilian Law

Resumo: U.S. privacy and its relationship with Brazilian Law are provided. The theme is a concern on the treatment that personal data receive from legal doctrine and Brazilian jurisdiction. There is a certain link between the right to privacy and intimacy and the protection of personal data. This is due to the fact that relationships between people, public and private institutions or non-governmental organizations are becoming highly demanding in data storing. In fact, concern on the protection of privacy is so high currently. Current information and vigilance society change quantitatively and qualitatively the criteria of the rights of the person. The metaphor of the glass man finds its place in the legal social and democratic state. Since Brazilian law refers explicitly to privacy and intimacy under the aegis of U.S. privacy laws, which may not be understood as the right to isolation, it is important to understand which systematization should be attributed to them. Contrastingly to what has been stated, it is relevant to define the concepts of private life and intimacy under an existential rather than a property perspective. The real person, subject to new technologies and feeling the needs for a broader and more differentiated type of tutelage, should be taken into account.

El motivo de esta temática revela preocupación con el tratamiento que la protección de los datos personales recibe, sea de la doctrina, sea de la jurisprudencia brasileña. En ese sentido, se percibe la relación entre el derecho y la privacidad y la intimidad con la protección de datos personales, una vez que las relaciones entre las personas, los órganos públicos y las entidades privadas o no gubernamentales están cada vez más exigentes en relación al archivamiento de datos. Así, la preocupación con la protección de la privacidad nunca fue tan grande como en el presente. De hecho, la sociedad de la información y de la vigilancia en que se vive altera cuantitativamente y cualitativamente los paradigmas de los derechos de personalidad. La metáfora del hombre de vidrio conquista espacio en pleno Estado Social y Democrático de Derecho. Por haber el derecho brasileño se referido expresamente a la vida privada y a la intimidad, además, a partir de la influencia de la privacy estadounidense, que no más debe ser entendida como derecho al aislamiento, necesario se hace que nosotros comprendamos cual es la sistematización que le deber ser atribuida. Al contrario de lo que se viene observando, se defiende aquí la importancia definirse contornos a los conceptos de vida privada y de intimidad desde la perspectiva existencial y no patrimonial, teniéndose como plan de fondo el individuo concretamente considerado que, sometido a nuevas tecnologías, siente necesidad de ser tutelado de forma más amplia y distinta.O presente artigo objetiva estudar o surgimento da privacy norteamericana e a relação com o direito brasileiro. O motivo desta temática revela preocupação com o tratamento que a proteção dos dados pessoais recebe, seja da doutrina, seja da jurisprudência brasileira. Nesse sentido, percebe-se certa ligação entre o direito à privacidade e à intimidade com a proteção de dados pessoais, uma vez que as relações entre as pessoas, os órgãos públicos e as entidades privadas ou não governamentais estão cada vez mais exigentes quanto ao arquivamento de dados. Assim, a preocupação com a proteção da privacidade nunca foi tão grande como no presente. De fato, a sociedade da informação e da vigilância em que se vive alteram quantitativamente e qualitativamente os paradigmas dos direitos de personalidade. A metáfora do homem de vidro conquista espaço em pleno Estado Social e Democrático de Direito. Por ter o direito brasileiro se referido expressamente à vida privada e à intimidade, aliás, sob influência da privacy norteamericana, que não mais deve ser entendida como direito ao isolamento, necessário se faz compreendermos qual a sistematização lhes deve ser atribuída.
