Resumo: The identity right, perceived as the personality right, provides relevant points about the identity subordinate to both the civil sphere and the criminal sphere, and there is the possibility of not only the human people to have this right as well the possibility of a legal entity to hold the identity right. Therefore, these aspects that this study seeks to analyze the importance of personal identity protection to society. Concluding therefore, the relevant adjustment to the society expectations against the legal protection of civil and criminal matters regarding to personality - identity rights.

Concluding therefore, the relevant adjustment to the society expectations against the legal protection of civil and criminal matters regarding to personality - identity rights.El derecho a la identidad, percibido como derecho de la personalidad, establece puntos relevantes sobre la identidad tutelada tanto en la esfera civil como en la penal, así como se verifica la posibilidad de que no solamente la persona humana sea titular del derecho a la identidad sino también la jurídica. Por lo tanto, a partir estos aspectos, ese estudio busca analizar la importancia de la tutela a la identidad personal y a la sociedad. Se concluye, así, por la adecuación a los anhelos de la sociedad frente a la protección jurídica civil y penal en lo que dice respecto a los derechos de personalidad – identidad.O direito à identidade, percebido como direito da personalidade, estabelece pontos relevantes acerca de a identidade ser tutelada tanto pela esfera cível quanto pela esfera penal, assim como se verifica a possibilidade de não só a pessoa humana, ser titular de tal direito como também a possibilidade de a pessoa jurídica ser titular do direito à identidade. É, portanto, sobre estes aspectos que o presente estudo busca analisar a importância da tutela à identidade pessoal para com a sociedade.
