Electoral process and public policies: reciprocal influences

Resumo: | The constitutive dialogue between fundamental rights and public policies is permanent, as they are one of the guiding forces for the realization of the rights mentioned. They legally constitute coordinated public policies of various agents, multi-institutionally (macro, micro and meso-institutional plans) to effect fundamental rights including those of social nature, such as those related to education, health, food, work, housing, leisure, security, social security, protection of motherhood and childhood, assistance to the destitute, among others. They should reflect a dialogue between the state and civil society, through such plans effected by the ideas of program, action-coordination and process. This scenario serves as a backdrop for the interdependent relationship between public policies and the electoral process, the spectrum of the micro-institutional plan with an idea of contradiction different from that learned in either the judicial or legislative process, allowing the construction of political party programs, e.g., the Worker’s Party (PT) and the Brazilian Social Democracy Party’s (PSDB) as well as their electoral coalitions, in power of the Brazilian Republic for the last 16 (sixteen) years, to not depart from the continuity and intensification of the alluded policies, given that they vie for the same voter base, and enabling the creation of redistributive social and universal programs, the final conclusion of the article. It was used the methodology of procedure anchored in the legal and political. |

Constituem, juridicamente, as políticas públicas uma atividade estatal coordenada de vários agentes, de maneira multi-institucional (planos macro, micro e mesoinstitucional), para efetivar direitos fundamentais, mormente os de caráter social, como aqueles relacionados à educação, à saúde, à alimentação, ao trabalho, à moradia, ao lazer, à segurança, à previdência social, à proteção à maternidade e à infância, à assistência aos desamparados, entre outros. Devem refletir um diálogo entre o Estado e a sociedade civil, por meio dos citados planos efetivados pelas ideias de programa, ação-coordenação e de processo. Esse cenário serve de pano de fundo para a interdependente relação entre as políticas públicas e o processo eleitoral, espectro do plano microinstitucional, com uma ideia de contraditório diversa daquela apreendida no processo judicial ou legislativo, permitindo que a construção dos programas políticos partidários, por exemplo, do PT e do PSDB e as suas coalizões eleitorais, legendas que estão no poder da República brasileira nos últimos 16 (dezesseis) anos, não se afaste da continuidade e da intensificação das aludidas políticas, tendo em vista que disputam a mesma base eleitoral, e possibilitando a criação de programas sociais de caráter redistributivo e universalista, conclusão final do artigo.
