The purpose of this monographic work is to demonstrate the competence of the Municipality of Jaguaruna / SC, regarding the legitimacy of the creation of Law 1.555 / 2014, on residential or commercial buildings in permanent preservation areas already consolidated as urban areas. Thus, in the developed research the exploratory level was used, due to the little knowledge that had on the subject, seeking to perfect itself on the problem in question. As for the approach, the research was sought in qualitative form, which asks the analysis of words in the inductive form. As far as data collection is concerned, bibliographical and documentary types were used, which include, respectively, the source in books, articles, and research directed to a stable and productive source of data. Thus, according to the study, it was verified that the Municipality has the power to legislate on environmental matters, taking into account the delegation of competence attributed to it by the Federal Constitution. Thus, the Municipality of Jaguaruna / SC has the legitimacy to legislate on environmental matters, as well as to create norms that regulate the universal law of the Union, according to the analysis in the present work, Law 1,555 / 2014 was created by the Municipality of Jaguaruna / SC to regulate the consolidated urban areas.
