THE REGULATION PROCESS OF WOMEN´S LABOR IN BRAZIL IN VIEW OF THE THEORY OF CAROL SMART: LAW AS GENDER TECHNOLOGIES

Resumo: Objective: This article has as object the process of women´s labor regulation in Brazil, having 1932 as its landmark. The legislation in the period is frequently presented as if it was only a women´s achievement, when it was actually also the element of their exclusion from the public space of work. Carol Smart's critique of law will make it possible to understand why.Methodology: The research used the historical-legal method (GUSTIN; DIAS; NICÁCIO, 2020, p. 80), from legal and doctrinal sources. The legislation of the time was recovered, regarding the regulation of women's work and the ideal of women spread by the Brazilian State, through its regulations, in the studied period.Results: The notion of Law as a technology of gender allowed a critical analysis of the process of legal regulation of women's work in Brazil, providing an understanding of the reasons why it legitimized the return of women to the home in the 1930s. In Smart's line, in addition to the content of the laws, it was the Law itself (discourse and form) that allowed this return.Contributions: It is intended to contribute to a critical look at the Law regarding its function to promote gender equality and non-institutional exclusion of women from the public space of work. It is believed that promoting and improving the discussion about the differentiation and binary opposition between the figure of man and woman, that is perpetuated in the field of Law, can serve this objective.

Esa legislación es presentada sólo como un logro de las mujeres, aunque también fue un factor en su exclusión del espacio público de trabajo. La crítica del derecho de Carol Smart permitirá comprender por qué.Metodología: Se utilizó el método histórico-jurídico (GUSTIN; DIAS; NICÁCIO, 2020, p. 80), basado en fuentes jurídicas y doctrinales. Se recuperó la legislación de la época, en cuanto a la regulación del trabajo de la mujer y el ideal de mujer difundido por el Estado brasileño.Resultados: La noción del Derecho como tecnología de género permitió un análisis crítico del proceso de regulación legal del trabajo de la mujer en Brasil, proporcionando una comprensión de las razones por las cuales legitimó el retorno de la mujer al hogar en la década de 1930. Además del contenido de las leyes, fue lo Derecho mismo (discurso y forma) lo que permitió este retorno: como tecnología de género, estabilizó una diferenciación entre mujeres y hombres sobre la base de la oposición binaria de la mujer cuidadora y el hombre proveedor.Contribuciones: Se pretende contribuir a una mirada crítica a lo Derecho en cuanto a su papel en la promoción de la igualdad de género y la exclusión no institucional de las mujeres del espacio público de trabajo. Se cree que promoverá la discusión sobre la oposición binaria que se perpetúa, entre el hombre y la mujer.Objetivo: O artigo tem por objeto o processo de regulamentação do trabalho das mulheres no Brasil, tomando-se 1932 como marco. A legislação, no período, é frequentemente apresentada apenas como uma conquista das mulheres, mas foi também fator de sua exclusão do espaço público de trabalho. A crítica do direito em Carol Smart possibilita compreender o porquê.Metodologia: Foi utilizado o método histórico-jurídico (GUSTIN; DIAS; NICÁCIO, 2020, p. 80), a partir de fontes legais e doutrinárias. Recuperou-se a legislação da época, no que concerne à regulamentação do trabalho das mulheres e ao ideal de mulher difundido pelo Estado brasileiro, por meio de suas normativas, no período estudado.Resultados: A noção do Direito como tecnologia de gênero permitiu uma análise crítica do processo de regulamentação jurídica do trabalho das mulheres no Brasil e dos motivos pelos quais legitimou o retorno das mulheres ao lar nos anos 30. Para além do conteúdo das leis, o próprio Direito (discurso e forma) permitia esse retorno, já que, enquanto tecnologia de gênero, estabilizava uma diferenciação entre mulheres e homens à base da oposição binária da mulher cuidadora e do homem provedor.Contribuições: Pretende-se contribuir para um olhar crítico sobre o Direito no tocante a sua função para promoção da igualdade de gênero e não exclusão institucional das mulheres do espaço público do trabalho.
