The Brazilian Tenancies Agreements: Historical and Legal Origins

Resumo: Part of the Law, Sociology and Economics researches consider that the tenancies’ practice is able to optimize the access to land, as a hypothesis. However, in Brazil, the tenancies has been increasingly unusual. On this context, the laws, the "enforcement" and the social configuration of the contracts would be relevant elements in order to understand the tenancies problem. This paper investigates the formation of tenancies in Brazil. The discussion focuses on the historical and legal dynamics of tenancies. The goal is to review major regulatory framework of rural leases, through the perspective of sociological interpretation of the law.

Contudo, no Brasil, os arrendamentos são pouco praticados e, dentre as causas para sua baixa utilização, cogita-se a debilidade das estruturas institucionais, a dinâmica das leis e a configuração social dos contratos. Partindo dessa vertente, o presente trabalho investiga a formação dos arrendamentos rurais no Brasil, focando em sua dinâmica histórica e jurídica.
