CIVIL INVESTIGATIONS ON ENVIRONMENTAL MATTERS IN LEGAL EDUCATION: THE LAW BEYOND THE TRIALS

Resumo: | In the teaching of Law, the study of practical cases gives prestige to the analysis of the content of judgments and decisions. However, in reality, there are complex legal problems that are not submitted to the Judiciary. Additionally, paradigm shifts between the late 20th century and the early 21st century, such as the recognition of diffuse and collective rights holders and the increase in extrajudicial techniques and methods of conflict resolution, demanded a new look toward legal education in times of complexity. Thus, we propose to analyze the extent to which civil inquiries can serve as the object of active and participatory methodologies capable of filling gaps and limitations that may exist in the study of judicial decisions in the teachings of Environmental Law. We assume that the interaction between civil investigations and active methodologies provides students with an opportunity for a broad and detailed analysis of the environmental issue complex. This is bibliographical and documentary research, with a qualitative approach. We conclude that the use of civil inquiries in the teachings of Environmental Law, with the use of active methodologies, benefits a protagonist formation of the student, in line with what the current legal system provides. Among them, “problem-based learning” stands out as one of the most fruitful for the study of extrajudicial procedures in question. |

Sin embargo, en la realidad existen problemas jurídicos complejos que no se someten al poder Judicial. Además, existen cambios de paradigma entre finales del siglo XX y principios del XXI, como el reconocimiento de titulares de derechos difusos y colectivos y el incremento de técnicas y métodos extrajudiciales de resolución de conflictos, que exigen una nueva mirada de la educación jurídica en tiempos de complejidad. En esa medida, se propone analizar en qué medida las investigaciones civiles pueden servir como objeto de metodologías activas y participativas capaces de colmar las lagunas y limitaciones que puedan existir en el estudio de las decisiones judiciales, en la enseñanza del Derecho Ambiental. Se parte de la hipótesis de que la interacción entre las indagaciones civiles y las metodologías activas ofrece a los estudiantes la oportunidad de analizar la compleja problemática ambiental de forma amplia y detallada. Se trata de una investigación bibliográfica y documental, con enfoque cualitativo. Se concluye que el uso de la investigación civil en la enseñanza del Derecho Ambiental, a través de metodologías activas, beneficia una formación protagónica del estudiante, en consonancia con lo que dispone el ordenamiento jurídico vigente. Entre ellas, se puede destacar el “problems based learning” como una de las más fructíferas para el estudio de los procedimientos extrajudiciales en enfoque.No ensino do Direito, o estudo de casos práticos prestigia a análise do teor de sentenças e acórdãos. Todavia, há problemas jurídicos complexos, na realidade, que não chegam a ser submetidos ao Judiciário. Além disso, há mudanças de paradigma, entre o fim do século XX e o início do XXI, como o reconhecimento de titulares difusos e coletivos de direitos e o aumento de técnicas e métodos extrajudiciais de resolução de conflitos, que demandam um novo olhar para o ensino jurídico, em tempos de complexidade. Nessa medida, propõe-se analisar em que medida os inquéritos civis podem servir de objeto de metodologias ativas e participativas capaz de suprir lacunas e limitações eventualmente existentes no estudo de decisões judiciais, no ensino do Direito Ambiental. Parte-se da hipótese de que a interação entre os inquéritos civis e as metodologias ativas proporciona aos estudantes uma oportunidade de análise ampla e detalhada da complexa problemática ambiental. Trata-se de pesquisa bibliográfica e documental, com abordagem qualitativa. Conclui-se que o uso do inquérito civil no ensino do Direito Ambiental, por meio das metodologias ativas, beneficia uma formação protagonista do aluno, em consonância com o que dispõe o ordenamento jurídico vigente.
