WRIT OF INJUNCTION: AN EFFECTIVE INSTRUMENT OF CONSTITUTIONAL RULES

Resumo: | This work has the purpose to study the Writ of Injunction, such as an instrument capable of accomplish constitutional rules pending regulatory. The study is carried out with a follow-up history of decisions made by the Supreme Federal Court, in which it is possible to see, at least, three evolutionary moments in the interpretation of this institute: the adoption of a theory not concretist movement, concretist movement intermediate and concretist movement individual and general. In this context, the text seeks to delimit what theory proves to be more compatible with what they wanted in 1988. In this regard, will be discussed and removed the obstacles constructed by a restrictive jurisprudence, who dominated the first years of the 1990s, especially the problem concerning the confrontation with the principle of separation of powers. In the end, the report presents an analysis of the reasons for the Supreme Court to adopt the recent and historic decisions that expanded the effectiveness of the instrument and what still has to evolve. |

O estudo é realizado com um acompanhamento histórico das decisões proferidas pelo Supremo Tribunal Federal, em que é possível visualizar, no mínimo, três momentos evolutivos na interpretação desse instituto: a adoção de uma teoria não concretista, concretista intermediária e concretista individual e geral. Nesse contexto, o texto busca delimitar qual teoria se mostra mais compatível com aquilo que se pretendeu em 1988. Nesse propósito, serão debatidos e afastados os obstáculos construídos por uma jurisprudência restritiva, que dominou os primeiros anos da década de 90, especialmente o problema relativo ao confronto com o princípio da separação de poderes.
