Resumo: The present work seeks to understand the problem of crime and its response, based on the same premise produced from the theory of the labeling that crime is a definition attributed to a particular act or person, as well as the social reaction resulting from a political definition / choice. Differently from the materialistic explanation of the economic conditioning of the sociopenal order, this work brings the culturalist understanding of crime and social reaction - from Christie's reasonable amount of crime to Garland's idea of tolerance of violence. The objective of this work is to problematize the mass incarceration from the social understanding of violence in a cultural perspective and to contribute elements for a broader understanding from another theoretical framework beyond Marxism.

Diferentemente da explicação materialista do condicionamento econômico da ordem sociopenal, traz-se nesse trabalho a compreensão culturalista acerca do delito e da reação social – desde a razoável quantidade de crime de Christie, até a ideia de tolerância a violência de Garland.
