Resumo: Analysis of the constitutive elements of the State - people, sovereignty and territory - under the paradigm of the Democratic State of Law. Initially, we will work the above mentioned elements, which are present in the classical doctrine. On a second moment, we will present a contemporary definition of such elements, proceeding this way to an opposition. Through this comparison, and focusing on the present stage of evolution of our civilization, in which notions such as globalization, neoliberalism and democracy are exhaustively discussed, we will try to show what we understand for the modern and appropriate Vision of the constitutive elements of the State in the Democratic State of Law context
