Resumo: This monograph aims to analyze the contributions that psychology can bring to criminal injustices perpetrated by psychopaths. In this context, it is necessary to analysis of the psychopath's situation in the Brazilian legal system. through from the analysis of behavioral traits, psychology directs us, through concepts established over the years, to verify if such individuals should actually be considered mentally ill. Furthermore, it is important to check whether the psychopath should be considered imputable, unimputable or semi-imputable, seeking the best and most effective treatment for each case, considering that Insufficient treatments are applied, not achieving the intended effectiveness, resulting in recidivism. Thus, it appears that the current legal system has a gap regarding the criminal responsibility of the psychopath, due to the lack of a specific legal provision to regulate such cases, which entails injustice and juridical insecurity. Therefore, the interference of psychology is sought to enable more specific and appropriate measures to be applied to the case in screen, as well as highlighting the negative impact generated by the state omission in view of these individuals

Nesse contexto, faz-se necessária a análise da situação do psicopata frente ao ordenamento jurídico brasileiro. Por meio da análise dos traços comportamentais, a psicologia nos direciona, através de conceitos estabelecidos ao longo dos anos, a verificar se tais indivíduos devem realmente ser considerados doentes mentais. Ademais, torna-se importante verificar se o psicopata deve ser considerado imputável, inimputável ou semi-imputável, buscando o melhor e mais eficaz tratamento para cada caso, considerando que lhes são aplicados tratamentos insuficientes, não alcançando a eficácia pretendida, resultando em reincidência. Deste modo, verifica-se que o atual ordenamento jurídico possui uma lacuna quanto à responsabilidade penal do psicopata, devido à falta de um dispositivo legal específico para regular tais casos, o que acarreta injustiça e insegurança jurídica.
