Resumo: This paper analyzes the influence that the power centralization by Brazilian jurists and judges had on the formation of the national political system. The period under analysis goes from the colonial times to the first republican government, in 1891. This is a crucial period for the study, since it is when an intense political action by jurists and judges takes place. The paper begins by establishing a few basic premises about the formation of the Portuguese State and the early times of the Brazilian colonization. Then it examines the different historical periods: the Colony, the First Reign, the reign of Pedro II, and the dawning of the Republic, with the government of Deodoro da Fonseca.

O período de análise vai do Brasil Colônia ao primeiro governo republicano, em 1891, período crucial para o estudo porque é nele que ocorre a intensa atuação política da magistratura no Estado brasileiro. Inicialmente são estabelecidas algumas premissas básicas sobre a formação do Estado português e os pri-mórdios da colonização brasileira. A seguir, são tratados os diferentes períodos históricos: Colônia, Primeiro Império, o reinado de d.
