Right to health and patient safety as fundamental rights in Brazil

Resumo: Objective: to discuss the right to health and patient safety as fundamental rights in Brazil. Methods: this is a descriptive, reflective study. Scientific texts were used through electronic searches in MEDLINE databases via PubMed and LILACS. Brazilian legislation and other documents from the World Health Organization, the National Health Surveillance Agency, and the Ministry of Health were included in the analysis. The study was conducted between August 2021 and February 2021, with no data cutoff. Results: with the recognition of health as a social right in the Constitution, the vulgar concept of health as the absence of disease has been defused, and such an expanded concept requires public policies to solve or minimize problems related to patient safety. The right to health must be based on the realization of fundamental rights and on the quality of health systems that must be offered by the state. Thus, patient safety is a characteristic of the quality of health care and a factor that must be considered by jurisdictions. In Brazil, there is a legislative gap on patient safety. The resolutions of the National Health Surveillance Authority and the National Patient Safety Program are the guiding documents for health care. Conclusion: it is noteworthy that the law can be considered as a core mechanism in the development and implementation of health care with quality and safety, since the law is the strongest instrument of intervention in society, which makes it necessary to search for specific legislation in Brazil.

Metodología: este es un estudio descriptivo, de tipo reflexivo, donde se utilizaron textos científicos, localizados por búsqueda electrónica en las bases de datos MEDLINE vía PubMed y LILACS, en la legislación brasileña y en otros documentos emitidos por la Organización Mundial de la Salud, la Agencia Nacional de Vigilancia Sanitaria y el Ministerio de Salud. Resultados: la Constitución, al reconocer la salud como un derecho social, descaracterizó el concepto vulgar de salud como la ausencia de enfermedad. Este concepto ampliado exige políticas públicas para resolver o minimizar los problemas que envuelven a la seguridad del paciente. El derecho a la salud debe basarse en la efectividad de los derechos fundamentales y en la calidad de los sistemas sanitarios que deben ser ofrecidos por el Estado. Así, la seguridad del paciente es un atributo de la calidad de la asistencia sanitaria y un factor que debe ser observado por las esferas del derecho. En Brasil existe un vacío legislativo en materia de seguridad del paciente. Las resoluciones de la Agencia Nacional de Vigilancia Sanitaria y del Programa Nacional para la Seguridad del Paciente constituyen los documentos rectores de la asistencia sanitaria. Conclusión: destaca que el derecho puede ser considerado un mecanismo central en el desarrollo e implementación de la asistencia sanitaria con calidad y seguridad, ya que la ley es el instrumento más fuerte de intervención en la sociedad, haciendo necesaria la búsqueda de una legislación específica en Brasil.Objetivo: discutir o direito à saúde e à segurança do paciente enquanto direitos fundamentais no Brasil. Metodologia: trata-se de um estudo descritivo, do tipo reflexivo, no qual se utilizou textos científicos, localizados por busca eletrônica nas bases de dados MEDLINE via PubMed e LILACS, a legislação brasileira e outros documentos emanados da Organização Mundial da Saúde, Agência Nacional de Vigilância Sanitária e do Ministério da Saúde. Resultados: a Constituição, ao reconhecer a saúde como um direito social, descaracterizou o conceito vulgar de saúde como a ausência de doença. Tal conceito ampliado demanda políticas públicas, de modo a resolver ou minimizar os problemas em torno da segurança do paciente. O direito à saúde deve se pautar na efetivação dos direitos fundamentais e na qualidade dos sistemas de saúde que devem ser oferecidos pelo Estado. Assim, a segurança do paciente é um atributo da qualidade do cuidado em saúde e um fator a ser observado pelas esferas do direito. No Brasil, há uma lacuna legislativa sobre a segurança do paciente. As resoluções da Agência Nacional de Vigilância Sanitária e o Programa Nacional de Segurança do Paciente constituem-se nos documentos orientadores do cuidado em saúde.
