Resumo: This paper discusses the police officer's discourse as a means of probability in crimes related to the practice of illicit drug trafficking in the Brazilian criminal process. To this end, using the hypothetical-deductive approach method with bibliographic, documentary and applied research, when analyzing the testimonial evidence in order to understand the police statement as a means of evidence, issues referring to the methodology established by the legal system will be addressed, especially the trust given by the democratic rule of law to public agents in the practice of their acts, so that we can understand their reflection as an artifice of evidence in the criminal process. That said, it seeks to answer how the legality of these facts is presumed, within the exact constitutional and legal limitations. Finally, it is concluded that the conviction should not be based exclusively on police statements, since the sentence must be provided through concrete evidence, under penalty of civil, administrative and criminal liability.

Para tal fim, utilizando-se do método de abordagem hipotético-dedutivo com pesquisa bibliográfica, documental e aplicada, ao analisar a prova testemunhal com o objetivo de compreender o depoimento policial como meio de evidência, serão abordadas questões referentes à metodologia estabelecida pelo ordenamento jurídico, sobretudo a confiança atribuída pelo estado democrático de direito aos agentes públicos na prática dos seus atos, para, assim, compreendermos seu reflexo como artifício de prova no processo criminal. Isto posto, busca-se responder como a legalidade desses fatos se presumem, dentro das exatas limitações constitucionais e legais.
