The Different Types of Work Contracts among Brazilian Skilled Workers

Resumo: Over the past decades working relationships have been continuously changed toward more flexible relations vis-à-vis labor relations of the traditional type. These transformations have also reached the Brazilian labor market, even though it has characteristics quite different from those of more developed economies. At the Brazil context, labor relations have always had a strong element of flexibility, since the formal and informal work is equally important in the economy. However, despite the informality in the Brazilian scenario, Brazilian skilled workers remained in stable work bonds, with CLT contracts, during the second half of the last century. But this scenario has been modified in recent decades. Although all these changes in labor market, research about different types of work contracts in the Brazilian market is scarce. Data relating to qualified professionals are even rarer. Considering this situation this paper aims to identify the different types of working contracts among skilled workers in Brazil. The paper discusses the results of empirical research and presents, based on literature and on data from 47 workers’ interviews, 15 variations of work contracts, which could be distinguished from CLT type. Considering these diversity the results of this research indicate that flexible labor relations cannot be taken as a homogenous process. The data also depict a troubling reality. We can say that there is a gap in the Brazilian context between current labor relations and the environment in which they operate. Brazilian society and labor laws are structured based on formal working relations. Organizations often do not know how to deal with a workforce with different contract types, facing complex problems arising from this situation. And workers in general are not prepared to act in this differentiated labor market. We emphasize that the workers are the weakest link in this context, struggling to maximize the positive and minimize the negative aspects associated with labor contracts that differ from traditional.

Estos cambios también han afectado al mercado de trabajo brasileño, a pesar de tener características distintas de las economías más desarrolladas. En Brasil, las relaciones laborales han siempre tenido un fuerte elemento de flexibilidad, una vez que el empleo formal e informal son igualmente importantes en la economía del país. A pesar de la informalidad presente en el escenario brasileño, los trabajadores calificados brasileños mantuvieron contratos de trabajo estables con CLT, en la segunda mitad del siglo pasado. Sin embargo, este escenario se ha modificado en las últimas décadas. A pesar de la confirmación de estos cambios en el mercado laboral, la investigación acerca de la propagación de los diferentes tipos de contratos de trabajo en el mercado brasileño es escasa. Datos relativos a trabajadores calificados son aún más raros. Tomando este escenario como telón de fondo, esta investigación tiene como objetivo identificar los diferentes tipos de contratos de trabajo existentes entre los empleados calificados en Brasil. Para ello, analiza los resultados de un estudio empírico, y presenta, a partir de la literatura y de los datos de las entrevistas con 47 trabajadores, 15 tipos de contratos de trabajo que difieren de la norma CLT. Los resultados muestran que, dada esta diversidad, las relaciones de trabajo flexibles no pueden ser tratadas como un proceso homogéneo. Los datos también muestran una realidad preocupante. Podemos decir que hay un vacío en el contexto brasileño de las relaciones de trabajo actuales y el medio ambiente en el que operan. La sociedad brasileña y la legislación del trabajo se estructuran sobre las relaciones de trabajo formales. Las organizaciones a menudo no saben cómo hacer frente a una fuerza de trabajo con diferentes tipos de contratos, tratando complejos problemas que surgen de esta situación. Y los trabajadores en general no están preparados para actuar en este mercado de trabajo diferenciado. Hacemos hincapié en que los trabajadores son el eslabón más débil en este contexto, que luchan para maximizar los efectos positivos y minimizar los aspectos negativos asociados a los contratos de trabajo que se diferencian de lo tradicional.Ao longo das últimas décadas as relações de trabalho têm se modificado de forma contínua na direção de contratos mais flexíveis vis-à-vis relações de trabalho mais estáveis e de longo prazo. Essas transformações também têm atingido o mercado de trabalho brasileiro, ainda que este tenha características distintas das economias mais desenvolvidas. No Brasil, as relações de trabalho sempre tiveram um forte componente de flexibilidade, uma vez que o emprego formal e o informal são igualmente importantes na economia do país. Apesar da informalidade presente no cenário brasileiro, trabalhadores qualificados brasileiros mantiveram vínculos de trabalho estáveis, com contratos CLT, ao longo da segunda metade do século passado. Entretanto, este panorama tem sido modificado nas últimas décadas. Apesar da constatação dessas mudanças no mercado de trabalho, pesquisas que investigam a disseminação de diferentes tipos de contratos de trabalho no mercado brasileiro são escassas. Dados referentes a profissionais qualificados são ainda mais raros. Tendo esse cenário como pano de fundo, essa pesquisa tem como objetivo identificar os diferentes tipos de contratos de trabalho existentes entre trabalhadores qualificados no Brasil. Para isso, discute os resultados de uma pesquisa empírica, e apresenta, com base na literatura e nos dados de 47 entrevistas com trabalhadores, 15 tipos de contratos de trabalho que se distinguem do padrão CLT. Os resultados mostram que, dada essa diversidade, as relações flexíveis de trabalho não podem ser tratadas como um processo homogêneo. Os dados também retratam uma realidade preocupante. Podemos dizer que existe um descompasso dentro do contexto brasileiro entre as relações de trabalho atuais e o ambiente no qual elas estão inseridas. A sociedade brasileira e a legislação trabalhista estão estruturadas com base nas relações de trabalho formais. As organizações muitas vezes não sabem lidar com uma força de trabalho com diferentes tipos de contrato, enfrentando problemas complexos decorrentes desta situação. E os trabalhadores em geral não estão preparados para atuar neste mercado de trabalho diferenciado.
