This paper presents a historical analysis of the right of women's work in order to point out the progress made by women in the legislative sphere, but also in so-ciety. Aimed to incite questions about the conditions of women's work, seeking to disbor. It was concluded that there were many legislative advances that allowed the women contest spaces with men, sharing night work contracts in unhealthy places and even harmful agents, before prohibited by previous legislation. However, there is still much to be gained in terms of the amount of female labor, which sometimes is also detailed compared to men's work. It is necessary to seek the fulfillment of the fundamental rights, in particular the constitutional principle of equality, reducing the distance be- tween the legal and real.
