The rights of psychic suffering carriers in the context of neoliberalism

Resumo: | This article brings into context the modern State in its various historical structures, trying to show the economic and social determinations in the building of Human Rights doctrine. Such dimension constitutes the central discussion in a debate that intensified, in a more preponderant way, in the 90’s by multilateral agencies, as well as sectors of the brazilian society in the matter of mental health field, that demands the citizenship of the mentally ill. It also shows that the mental institution was a necessary institution in the industrial capitalist time, which produced the segregation of the mentally ill and that in times of neoliberalism and globalization, it is possible to accept the idea of rights for this population in the theoretical field, even though not fully accomplished in reality. Mental Health.Este artigo faz uma contextualização do Estado moderno, nas suas diferentes conformações históricas, procurando demonstrar as determinações econômicas e sociais na construção do ideário dos direitos humanos. Esta dimensão constitui-se numa discussão central no debate que se intensifica, de forma mais preponderante a partir dos anos de 1990, promovido tanto por agências multilaterais como por setores da sociedade brasileira, na pauta do campo da saúde mental, que reivindica a cidadania às pessoas portadoras de sofrimento psíquico. Assim, conclui-se que o manicômio foi uma instituição necessária na fase do capitalismo industrial, que produziu a segregação e a tutela dos portadores de sofrimento psíquico, e que, em tempos de neoliberalismo e globalização, é possível ser aceita no campo teórico a noção de direitos a este segmento, ainda que concretamente não realizáveis.
