Resumo: In the face of social developments and increased risks, civil liability must deal with new types of damage. Social damages are primarily aimed at repairing injuries suffered by some immaterial legal asset of society and take place in cases where it has been effectively harmed. However, decisions are perceived in the Brazilian judiciary in which there is a conviction for the aforementioned damages in individual actions, in which the plaintiff seeks compensation for the damage borne by him, individually, and official convictions. Through the investigative and deductive method, the purpose of the social damage and the nature of immaterial damages were analyzed, when applied according to the current Brazilian legislation. The verified hypothesis occurred as to its application in the collective demands, through which, the society seeks, through its representatives, the repair of a damage caused to an immaterial legal asset protected by the Law. However, there is no need to talk about the application of such damages to individual claims, in which the objective of the dispute is to compensate for damage sustained individually.

Os danos sociais objetivam primordialmente a reparação das lesões sofridas por algum bem jurídico imaterial da sociedade e têm lugar nos casos em que esta tenha sido efetivamente lesada. Entretanto, percebe-se decisões no judiciário brasileiro em que há a condenação nos referidos danos em ações individuais, nas quais o autor busca a compensação do dano suportado por si, de forma individual e condenações de ofício. Por meio do método investigativo e dedutivo se analisou a finalidade do dano social e a natureza dos danos imateriais, quando sua aplicação de acordo com a legislação brasileira vigente. A hipótese verificada se deu quanto a sua aplicação nas demandas coletivas, por meio das quais, a sociedade busca, através de seus representantes, a reparação de um dano causado a um bem jurídico imaterial tutelado pelo Direito.
