Abortion and human reproduction: The necessary gender equality before the federal constitution

Resumo: The constitutionally foreseen gender equality and the guarantee of human dignity, in addition to the protection of personality, ensure the man the right to participate in the decision regarding the performance of an abortion, not being exclusive to the woman, as it is a theme related to reproduction human and not personal right. This article aims to adjust or adopt a premise different from that commonly invoked in the debate on abortion, that is, the approach focused only on the right of women to their own body, an element that is used as a primary source even by legislation that regulates abortion, such as the Laws of Argentina, France, Spain, and Uruguay. Considering the perspective of human reproduction with the necessary participation of man, either from the aspect of genetic material, or from the psychosocial and legal aspect, regarding the guarantee of gender equality, human dignity and protection of the male personality, the exclusion of men from the decision to abort is incalculable, and such a decision is not within the exclusive scope of the subjective right of women, making it necessary for men’s prior knowledge and consent to the practice of abortion.

Considerando la perspectiva de la reproducción humana con la necesaria participación de los hombres, ya sea desde el aspecto del material genético o desde el aspecto psicosocial y jurídico, en lo que respecta a garantizar la igualdad de género, la dignidad de la persona humana y la protección de la personalidad masculina, existe La exclusión de los hombres de la decisión de abortar se considera imposible, ya que tal decisión no está incluida dentro del ámbito exclusivo de los derechos subjetivos de las mujeres, siendo necesario el conocimiento y consentimiento previo de los hombres para la práctica del aborto.A igualdade de gêneros constitucionalmente prevista e a garantia à dignidade humana, além da proteção à personalidade, asseguram ao homem o direito de participar da decisão a respeito da realização de aborto, não cabendo à mulher exclusividade, por se tratar de tema afeto à reprodução humana e não direito personalíssimo. Este artigo objetiva ajustar ou adotar premissa diversa da comumente invocada no debate a respeito do aborto, isto é, a abordagem focada apenas no direito da mulher ao próprio corpo, elemento esse utilizado como fonte primária até por legislações que regulam o aborto, tais quais as Leis da Argentina, França, Espanha e Uruguai.
