Resumo: The rescissory action, for its uniqueness and exceptional nature, as well as a result of the different interpretations of the law, is a recurring theme of debate between legal experts and legal practitioners, even more the ones dedicated to the civil procedural law. Such debates arise from its hypotheses of applicability, in special the lapsing of the right of action, which initial term is responsible for controversies and discussions. This monography has the objective to analyze the expiring deadline and its initial term, showing the position deviations, legal doctrine and jurisprudence, considering the Code of Civil Procedure from 1973 and the New Civil Procedure Code from 2015. The debates among the superiors courts from Brazil analyzing the subject will be shown and described, as well as the proposal for a solution stipulated in the New Civil Procedure Code from 2015

Tais discussões transcorrem das suas hipóteses de cabimento aos seus requisitos, bem como acerca de seu prazo decadencial, cujo termo inicial gera grandes polêmicas e discussões. O presente trabalho visa aprofundar a análise do prazo decadencial e seu termo inicial, frente as discussões e divergências de posicionamentos doutrinários e jurisprudenciais, sob a égide do revogado Código de Processo Civil de 1973, bem como após a vigência do atual Código de Processo Civil de 2015.
