The labor succession, under Articles 10 and 448 of the Labor Code, has as main objective the realization of protection to workers in the face of possible changes in the legal structure of the company for which offers his hand labor. These changes in the legal structure of the company will have as one of its natural consequences the transfer of successful employer responsibility for the due performance of the funds under the employment contract between the employee and the company, a situation which materializes one of the governing principles to this case, namely, the depersonalization of the employer's figure member of its corporate structure. Thus, this study has the objective of analyzing the so-called labor succession and the consequences of this legal act as the responsibility which will fall to both partners as successors to succeed, bringing up the view of doctrine and jurisprudence on this subject.
