Resumo: The present study consists of the analysis of the contradictory in the civil process. It is intended to demonstrate the evolution of the institute and its strong presence in the current Code of Civil Procedure. It proposes a concept of contradictory and that the institute has a nucleus, which is the participation and the guarantee of influencing the judicial pronouncement. In importance, the guarantee principle has distinctions with ample defense, isonomy and cooperation. And it is in this context that, preserving the separation of powers, is that the process reaches other limits, expansive, out of the records. And in the need of interpretation of the legal matter, legality has another meaning
