The National Solid Waste Policy (PNRS), promulgated by Law nº 12.305 of August 2, 2010, has as one of the main objectives the final environmental disposal of solid wastes. For this, the law provides instruments and actions, which induce or stimulate the reduction of waste generation. One of these economic instruments to encourage the National Solid Waste Policy Law -Law nº 12.305 / 10 -is the Payment for Environmental Services, which lists the economic instruments of Decree nº7404, December 23, 2010. In this form, the Payment for Environmental Services (PES) system presents itself as a mechanism with great potential to encourage the preservation and recovery of the ecosystems that provide such services. The work verifies the possibility of using PSA as an economic mechanism to mitigate and adapt to the effects of the National Policy on Solid Waste in Brazil. In order to do so, it analyzes the main legal aspects of the PES system, such as the concept of PES and environmental services, its legal nature, its elements and its problems, as well as analyzes the Solid Waste Management to see if PES is possible in the urban context and can be applied effectively in the National Solid Waste Policy (PNRS), thus bringing its legal aspects, principles and the thematic of the economic instruments in PNRS
