Resumo: The aim of this paper is to know the consensual criminal justice and its specimens aiming at the unlocking of the Brazilian judiciary, the speed in the resolution of the conflict, as well as the approach between accused and prosecution, thus aiming at the negotiation of the punishment that sometimes , results in a less severe penalty than that provided in the abstract for the crime. As a result of the emptying of the Brazilian judiciary, it is reserved a space for the resolution of more serious crimes that generally require more resources, complexity and time for their solution
