Resumo: This study aims to analize the controversies surrounding the admissibility of necessary active co-parties. It briefly explains the classification of co-parties. It addresses the need of the presence of all the co-holders of right in the active pole of demand for the exercise of the right of action, considering the subjective limits of res judicata, in conflict with the right of the coholder of not being in court, against the principle of willingness of right of action. It brings examples of cases of necessary active co-parties. It points solutions brought by doctrine and the legal understanding of the subject. And last, it presents my positioning on the subject
