The present monograph has the great challenge of using the concepts and analysis of the structure of the constitutional juridical norm and civil procedural, notably the aspects of their normative and jurisprudential antecedent, to analyze the impact of the unconstitutionality declaration of the norm used in the judgment of a certain cause in demands whose decisions have already been covered up by the res judicata. The starting point was the analysis of the res judicata in our juridical order, analyzing their effects, limits and typical forms of relativization, until we get to the main point of the study, the analysis of the res judicata based on a norm that was later declared unconstitutional. Although the issue has already been studied by great exponents of the Brazilian civil procedural law, the discussions on this theme are likely to gain more emphasis in the current scenario, especially due to the judgment conducted by the plenary of the Supreme Court, when the effects of unconstitutionality frclaration were widely discussed and how they would be projected on the demands covered up by the the res judicata
