O objetivo da perícia de investigação de paternidade é determinar, a partir de um trio, filho(a), mãe e pretenso pai, se este pode ou não ser excluído da possibilidade de ser o seu pai biológico. Se, por qualquer razão, o pretenso pai não estiver disponível pode proceder-se ao estudo dos seus familiares próximos, o que aumenta a complexidade da perícia, quer em termos analíticos, quer de valorização estatística dos resultados. Tem-se constatado que nos últimos anos são solicitadas perícias de parentesco biológico cada vez mais exigentes no que concerne à valorização estatística de resultados.Uma perícia forense de investigação de paternidade biológica é mais do que a análise genética e os cálculos estatísticos realizados, é também, e não menos importante, todo o processo de identificação dos diferentes intervenientes no processo. A presença da mãe é, também por isso, muito importante, permitindo o reconhecimento e/ou a confirmação da identificação do pretenso pai. No entanto, e do ponto de vista científico, as perícias de investigação de paternidade biológica podem ser realizadas na ausência da mãe, sendo a informação genética disponibilizada por estes familiares (pretenso pai e filho(a)), na maior parte dos processos, suficiente para permitir concluir a perícia. A obrigatoriedade da participação da mãe nas investigações biológicas de paternidade, e todas as questões a ela inerentes, têm sido objeto de debate. Deste modo, a partir da comparação dos resultados e conclusões decorrentes do estudo trio pretenso pai-mãe-filho(a) e somente com pretenso pai-filho(a), realizados em investigações de paternidade biológicas, pretende-se formar e sustentar uma opinião do ponto de vista científico. O presente trabalho pretende comparar os valores de IP (Índice de paternidade) e W (Probabilidade de paternidade) obtidos em investigações de paternidade biológica com pretenso pai e filho(a), na presença e na ausência da mãe, de modo a determinar o impacto da presença/ausência da mãe na valorização estatística, na segurança e na clareza das conclusões destas perícias. Neste trabalho, comparou-se ainda o número de exclusões na presença e na ausência da mãe em casos de exclusão da paternidade.Investigations of biological kinship are mostly paternity investigations. The purpose of the paternity investigation expertise determines, from a trio, son, mother and alleged father, whether or not he can be excluded from the possibility of being his biological father. If, for any reason, the so-like parent is not available, the study of his close relatives can be carried out, which increases the complexity of the expertise, both in analytical terms and in statistical evaluation of the results.It has been observed that in recent years, increasingly demanding biological kinship expertise has been requested regarding the statistical valuation of results.A forensic expertise of biological paternity investigation is more than genetic analysis and statistical calculations performed, it is also, and not least, the whole process of identifying the different actors in the process. The presence of the mother is also therefore very important, allowing the recognition and/or confirmation of the identification of the alleged father. However, and from the scientific point of view, the investigation of biological paternity can be carried out in the absence of the mother, and the genetic information provided by these relatives (alleged father and son), in most processes, is sufficient to allow the completion of the expertise.The mandatory participation of the mother in biological investigations of paternity, and all the issues inherent to it, have been the subject of debate. Thus, from the comparison of the results and conclusions resulting from the study of the alleged father-mother-child and only with alleged father-child, carried out in biological investigations of paternity, it is intended to form and sustain an opinion from the scientific point of view. The present work aims to compare the values of PI (Paternity Index) and W (Paternity Probability) obtained in investigations of biological paternity with alleged father and child, in the presence and absence of the mother, and to determine the impact of the presence/absence of the mother on the statistical valorization, safety and clarity of the conclusions of these investigations.
