spelling Virtudes e problemas do financiamento de litígios por terceiros - um olhar sobre a possível utilização no contencioso judicial portuguêsADVANTAGES AND DISADVANTAGES OF “THIRD-PARTY FUNDING” - A LOOK AT THE POSSIBLE USE IN PORTUGUESE JUDICIAL LITIGATIONTPFvantagensdesvantagensinteressescontencioso judicialTPFadvantagesdisadvantagesinterestsjudicial litigationDissertação de Mestrado em Ciências Jurídico-Forenses apresentada à Faculdade de DireitoCabe na presente dissertação o estudo do Financiamento de Litígios por Terceiros,com uma maior análise às virtudes e problemas incluídos neste mecanismo.Tem como objetivo ponderar ambos os lados, de forma a percebermos o seu real benefícioou, ao invés, possíveis consequências prejudiciais para os ordenamentos onde for utilizado.Iremos começar por explicar em que se baseia o mecanismo, passando a uma análisehistórica, sem esquecer problemas atuais que tornam o desenvolvimento deste tipo definanciamento tardio.A relação entre o (terceiro) financiador e o financiado será alvo de escrutínio,percebendo como se molda às circunstâncias presentes em certas situações, além de umapassagem no âmbito contratual da relação e a luta de interesses propostos por ambos oslados.Segue-se uma análise profunda a várias vantagens do TPF, percebendo como se organizamno seio do mecanismo e o que podem trazer à mesa dos litígios, sendo o acesso à justiça abandeira do mesmo.Continuando na mesma senda, também os problemas serão alvo de estudo,enquadrando-os no revés possível da aplicação do mecanismo pelo mundo, com o aumentode litígios que acarretam também uma maior litigância sem mérito, como é afirmado porcertos autores.Um olhar também sobre a relação trilateral do demandante, do advogado, enquantoseu representante, e do financiador. Como se colocam os vários interesses em ponderação,assim como os deveres que advêm de cada posição dos sujeitos no decorrer da ação.Concluindo, encontramos uma ponderação entre as virtudes e desvirtudes do TPF,fazendo um balanceamento entre o que pode ser corrigido, melhorado ou exponenciado,sem nunca esquecer a possibilidade de utilização do mesmo no ordenamento jurídicoportuguês, especialmente no contencioso judicial.This dissertation is responsible for the study of “Third-Party” Litigation Funding,with further analysis of the virtues and problems included in this mechanism.Its purpose is to weigh both sides in order to realize its real benefit or, on thecontrary, possible harmful consequences for the systems where it is used.We will begin by explaining what the mechanism is based on, moving on to ahistorical analysis, without forgetting current problems that make the development of thistype of financing late.The relationship between the (third-party) funder and the funded party will be the subject of scrutiny, understanding how it is shaped by the circumstances present in certainsituations, in addition to a passage in the contractual scope of the relationship, and thestruggle for interests proposed by both sides.This is followed by an in-depth analysis of the various advantages of the TPF,understanding how they are organized within the mechanism and what they can bring to thetable, with access to justice being the flagship of the mechanism.Continuing in the same vein, the problems will also be studied, framing them in apossible setback of the application of the mechanism around the world, with the increase ofthe litigation that also leads to greater litigation without merit, as stated by certain authors.A look also at the trilateral relationship of the party, the lawyer as its representative,and the funder.
