O direito do urbanismo reflete-se de modo inquestionável no campo de ação do registo predial, desde logo porque ambos têm o território, poderemos assim dizer, como objeto e se o primeiro pretende a sua organização ordenada, o segundo ao dar publicidade à situação jurídica dos prédios, tem como fim primordial a segurança do comércio jurídico.Pretende-se, com o presente, efetuar uma “ponte” entre o Direito do Urbanismo e o Registo Predial português. Na verdade, muito se tem escrito sobre o direito do urbanismo mas na perspetiva do direito administrativo, e pouco sobre os efeitos deste no registo predial.Esta dissertação começa por retratar a evolução do registo predial, no sentido de lhe ter sido atribuída cada vez mais importância, na história legislativa do urbanismo, tentando sempre realçar os efeitos registrais, passando obviamente, pelo desenvolvimento do conceito do instrumento urbanístico de maior relevo, o loteamento.Para posteriormente, nos centrarmos nos efeitos tabulares do loteamento e principalmente nos efeitos que a cassação do título, que serve de base ao seu registo, vão ter no prédio, quer com a declaração de caducidade, quer com a declaração de nulidade, para que através destas matérias, se percebesse da magnitude do impacto dos atos administrativos urbanísticos no prédios e nos direitos nele inscritos. Esperamos dar uma nova, e útil, visão do urbanismo, para que mais interesse no campo do registo predial apareça. Desta forma se prevê um trabalho, que apesar de breve mas com o essencial do tema proposto, se acredita ser uma mais-valia para o estudo do urbanismo na ótica do registo predial.The evolution of society has led to the need for greater regulation of urbanism and a greater reflection of this in the land register. The Urban Planning Law is unquestionably reflected in the field of action of Property Registration, since both have the territory, so we can say, as object and if the first intends its orderly organization, the second in publicizing the legal situation of property, has as its primary propose the security of legal commerce.It is intended, with the present work, to make a “bridge” between the Urban Planning Law and the Portuguese Property Registration. In fact, much has been written about the Urban Planning Law but from the perspective of administrative law, and little about the effects of Urban Planning on Property Registration.This dissertation begins by describing the evolution of the land registry, in the sense that it has been assigned more and more importance, in the legislative history of urbanism, always trying to highpoint the registration effects, passing obviously by the development of the concept of the most important urbanistic instrument that allows land division.Then, we focus on the tabular effects of the land division and, in particular, on the its effects of the cassation of the license, the title which serves as legal document for its registration, will have on the property registration, its registral description, either with the declaration of the expiration or with the declaration of nullity, so that through these matters, one could perceive the magnitude of the impact of the urban administrative acts on the registral description and the rights inscribed in that.We hope to give a new, and useful vision of urbanism, so that more interest in the field of property registration appears.
