Segredo de justiça347.9Dissertação de mestrado em Direito Judiciário - Direitos Processuais e Organização Judiciária (área de especialização em Direito Processual Penal)A presente dissertação de mestrado consiste no estudo precípuo do segredo de justiça e a sua tensão dialéctica com a publicidade do processo no âmbito do Direito Processual Penal português. Aqui, aflora-se a abordagem histórica do segredo de justiça e a sua atualidade, a sua noção e plano axiológico, a descrição estrutural do instituto através dos seus âmbitos material e subjectivo (violação de segredo de justiça) e os seus limites temporais. Outrossim, já no âmbito da publicidade, se expõe sobre a assistência do público a atos processuais, a breve alusão aos meios de comunicação social, a consulta de auto e obtenção de certidão e informação por sujeitos processuais, bem como a consulta de auto e obtenção de certidão por outras pessoas. Verificámos que no Código de Processo Penal português ressaltam diferenças significativas nas versões até agora vistas e, consequentemente, estão em causa Direitos, Liberdades e Garantias que a Constituição da República Portuguesa defende e assegura aos cidadãos, dizendo-o expressamente “a lei define e assegura a adequada protecção do segredo de justiça” (n.º 3, do art. 20.º, da C.R.P.) e, por outro lado, está o direito à informação dos cidadãos (arts. 37.º e 38.º da C.R.P.), sendo que os direitos contendem e, por isso, cabe ao legislador, encontrar o ponto ideal, capaz de evitar os conflitos de interesses, para que, se alcance o princípio constitucional de que, “todo o arguido se presume inocente até ao trânsito em julgado da sentença de condenação, (…).” (n.º 2, do art. 32.º, da C.R.P.). Parece-nos, portanto, oportuno fazer um breve estudo de direito comparado de vários ordenamentos jurídicos, no sentido de encontrar respaldo normativo dos direitos supra mencionados nos sistemas investigados e aquilatar da adequada resolução que os vários sistemas jurídicos oferecem para esta quezília. Neste contexto, propõe-se a criação de gabinetes de assessoria de imprensa optando, assim, como solução, pelo modelo do ordenamento jurídico alemão no que diz respeito ao conflito dos direitos.This work is centred on “Investigation Secrecy” and its dialectical tension with the publicity of criminal procedure in the Portuguese Criminal Procedure Law. Here we discuss the historical approach to the investigation secrecy and its current affairs, its axiological notion and plan, the structural description of the institute through its concrete and subjective areas (breaching of investigation secrecy), and its time limits. Moreover, in the area of advertising, we expose the public's attendance to pleadings, the brief allusion to the media, the consulting of case files and the acquisition of certificates and procedural information through subject procedurals, as well as the consulting of case files and the acquisition of certificates through others. It is highlighted in the Portuguese Criminal Procedure Law significant differences in the versions seen so far, and therefore are called into question the Rights, Freedom and Guarantees that the Constitution of the Portuguese Republic advocates and assures to its citizens, explicitly stating: "the law defines and ensures the necessary protection of the investigation secrecy" (n. 3 of the 20th art. of the C.P.R.), on the one hand, and the right of citizens to information (the 37th and 38th art. of the C.P.R.), on the other hand. Since these rights contend it is up to the legislator to find the ideal point, and be able to avoid conflicts of interest so that the constitutional principle, which states that “every defendant is presumed innocent until proven guilty (...)” (n. 2 of the 32nd art. of the C.P.R.), is reached. Thus, it seems important to do a brief study of comparative law about several legal systems in order to find some normative background to the laws mentioned above in the investigated systems, and encounter the ideal resolution from the ones these juridical systems offer to solve.
