Inicialmente tratamos do desenvolvimento dos direitos da criança, os avanços dos tratados internacionais e da proteção constitucional que acarretaram no abandono da ideia de criança-objeto para reconhecimento da criança como sujeitos de direitos. Em seguida, observamos a construção do direito social à saúde, sua evolução como direito humano e o papel do Estado Social para sua positivação constitucional nos dois países, que apresentam diferenças quando do reconhecimento do direito à saúde como direito fundamental exigível. Assim, constrói-se o conceito da efetividade do direito fundamental social à saúde da criança, o papel da intervenção judicial no campo das políticas públicas, que se dá pelo fenômeno da judicialização da matéria, propondo ao final, a observância do princípio do superior interesse através das suas três grandes características: como um princípio jurídico de conceito indeterminado; como um princípio vinculativo das instituições públicas ou privadas de proteção social, por tribunais, autoridades ou órgãos legislativos; e como um princípio processual. Finalmente, propomos a quarta análise do PSI, como parâmetro para a efetividade das políticas públicas em saúde, e seu papel como “arma axiológica” a salvaguardar os interesses das crianças.This paper analyzes the effectiveness of the social right to health of children in both Portugal and Brazil, its constitutional protection and the inclusion of the principle of the best interest of the child as guidance to political and judicial action. Initially we address the development of children's rights, with the advancement of international treaties and the constitutional protection that resulted in the abandonment of the idea of the child as an object for the recognition of the child as subject of rights. Then we discuss the construction of the social right to health, its evolution as a Human Right and the role of the Welfare State in its constitutional inclusion in both countries, with their differences in the recognition of the right to health as a enforceable fundamental right. Thus, the concept of the effectiveness of the fundamental social right to the health of the child is constructed, the role of judicial intervention in the field of public policies, that is given by the phenomenon of the judicialization of the subject, proposing in the end, the observance of the principle of superior interest through its three major characteristics: as a legal principle of undetermined concept; as a binding principle of public or private institutions of social protection, courts, authorities or legislative bodies; And as a procedural principle.
