In this context, the regulation of renewable energies is very important. The inherent characteristics of the sector require the existence of players who, in the use of their powers, try to reconcile public interests (the safeguarding of the environment and the supply of an essential good) with private interests (investment in an economic sector). So much so that the interveners in this regulatory process try to establish legal frameworks that on one hand try to encourage investment in this area, and on the other, ensure the supply of electricity. The question arises as to how this sector is regulated, through which actors, and what legal framework currently applies to possible stakeholders in the renewable energy market. The question is whether environmental concerns really led to the establishment of an incentive regime for electricity production using renewable energy sources.After a process of analysis of the regulatory action, of its actors in the Portuguese electricity sector, and of the regime of Decree-Law no. 162/2019, of 25 of June, and of the amendment brought by Decree-Law no. 76/2019, of 3 of june it is intended to be able to answer the question: a (dis)encouraging legal framework?..........................................................As energias renováveis desempenham um papel fundamental tanto para responder a preocupações ambientais, enquanto motores essenciais para a descarbonização da economia, como para assegurar o fornecimento de um bem essencial e necessário nas sociedades atuais (a eletricidade). Neste contexto, a regulação das energias renováveis é de suma importância. As características inerentes ao setor obrigam à existência de intervenientes que, no uso dos seus poderes, tentam compatibilizar interesses públicos (a salvaguarda do meio ambiente e o fornecimento de um bem essencial) com interesses privados (o investimento num setor económico). Tanto que os intervenientes neste processo regulatório tentam estabelecer regimes jurídicos que por um lado tentem incentivar o investimento nesta área, e por outro assegurar o fornecimento de eletricidade. Coloca-se a questão de saber de que modo é feita a regulação deste setor, através de que intervenientes, e qual o regime jurídico aplicável atualmente a possíveis interessados no mercado das energias renováveis.
