O presente estudo procura abordar temáticas atuais e cada vez mais importantes nos dias que correm: o direito à informação administrativa, o direito à proteção de dados pessoais e a sua ligação em especial, aos procedimentos urbanísticos. Veremos que são matérias relacionadas e nem sempre em harmonia, que abordam questões atuais e pertinentes na sociedade em que vivemos. O direito à informação administrativa pode ser por todo o cidadão exercido, porém, veremos que em determinadas circunstâncias, surgem limites associados a este direito que poderá entrar em conflito com o regime da proteção de dados pessoais. Articular estes temas e encontrar uma harmonia será o desafio que teremos em diante.O direito à informação administrativa, encontra a sua origem no princípio da transparência administrativa e desdobra-se essencialmente em duas vertentes: uma que visa tutelar interesses e posições jurídicas procedimentais (direito à informação procedimental) e outra que se destina a todos os cidadãos, ainda que não exista nenhum procedimento em curso que lhes diga respeito (direito à informação não procedimental).O princípio da proteção dos dados pessoais, por seu turno, consagrado na mesma legislação, e na Lei de Proteção de Dados Pessoais (“LPDP”), estipula que todos têm direito à proteção dos seus dados pessoais.Ambos os princípios têm entidades administrativas independentes responsáveis por assegurar o seu cumprimento. Estas competências podem-se sobrepor, potenciando, um aparente conflito de competências, e possíveis divergências de entendimentos sobre as mesmas matérias.Numa sociedade altamente informatizada, os dados pessoais ganham cada vez mais importância e legislar neste âmbito torna-se por isso, e cada vez mais, necessário.The main objective of this dissertation is to relate the right of administrative information and the legal regime of personal data protection to the consultation of urban procedures. The present study seeks to address current and increasingly important issues these days: the right to administrative information, the right to the protection of personal data and its connection, in particular, to urban planning procedures. We will see that they are related matters and not always in harmony, which address current and relevant issues in the society in which we live. The right to administrative information can be exercised by every citizen, however, we will see that in certain circumstances, limits arise associated with this right that may conflict with the regime of protection of personal data. Articulating these themes and finding harmony will be the challenge ahead.
