A Lei oferece sua proteção para aquele que tem direito ao sustento por meio desses alimentos. Para esse fim, deve-se fixar a verba alimentar na proporção das necessidades de quem pede e dos recursos da pessoa obrigada, sem desfalque do necessário ao seu sustento. Se a prestação de alimentos é direito dos filhos e obrigação dos genitores, estes são litisconsortes nessa responsabilidade. Caso não apresentem condição financeira para o suprimento das necessidades da prole, a obrigação pode ser complementada pelos avós. Os direitos do alimentado precisam ser cumpridos espontaneamente para manutenção do equilíbrio psicológico dos filhos. Ainda, se houver necessidade, pode haver a fixação judicial da prestação alimentícia, e quando o alimentante não cumpre sua obrigação, a legislação vigente permite ao alimentando/necessitado algumas formas patrimoniais e pessoal de exigir seu direito. Caso os parentes em linha reta estejam impossibilitados do cumprimento dessa obrigação, a lei permite que aqueles em linha colateral auxiliem na manutenção da vida daquele que necessita do alimento. A Lei procura ser o mais justa possível no sentido de manter o equilíbrio psicológico e alimentar do reclamante.The food providing subject is of great importance and bigger seriousness, The Law offers its protection to those who have the right to support through food. To that end, it must be established the food support on the amount balanced between the need of those who request and the possibility of those who offer, not leaving the supporter without the necessary to live. If the food provision is the right of the children and obligation of the parents, the latter are co-responsible for the feeding. Should they not afford financial condition for the supply of the children’s needs, the obligation can be complemented by the grandparents. The rights of the fed ones must be fulfilled spontaneously for the keeping of the children’s sanity. Still, if the re is the need for law reinforcement on the keeping of the promise, and when the feeder doesn´t keep his part of the commitment, the law allows for some ways to make the supporter keep his promise and carry on with his responsibility. In case the relatives in first degree cannot keep their obligation, the law says that those immediately below them in this family lineage help maintaining the life of those who need support.
