Monografia (Graduação) - Universidade Católica de Brasília, Brasília , 2012.https://repositorio.ucb.br:9443/jspui/handle/10869/2015DireitoHouve uma grande evolução histórica dos direitos da criança e do adolescente, o que fica claro na Doutrina de Proteção Integral trazida pela Convenção de Direitos da Criança em 1989, e posteriormente adotada no Brasil, por intermédio da Lei 8.069/1990 que instituiu o Estatuto da Criança e do Adolescente. O Estatuto traz o processo de apuração em caso de crime ou contravenção praticados por adolescentes, e dita como serão aplicadas as chamadas medidas socioeducativas. Entre as medidas, está a de Internação, aplicada a adolescentes que cometeram ato infracional mediante violência ou grave ameaça à pessoa, ou ainda quando esse adolescente não cumpriu, por motivo injustificado, outra medida anteriormente imposta. Essa medida é cumprida em uma Unidade de Internação, onde esse jovem, em tese, terá todo o suporte para sua estruturação psicológica para que se torne um cidadão completamente capaz de construir uma trajetória satisfatória em sua vida, conquistando suas metas por intermédio do trabalho, em convivência com a família, se desvencilhando totalmente da criminalidade. As medidas socioeducativas tem como objetivo principal a ressocialização do menor infrator, ou seja, sua saída da vida infracional. A ressocialização se torna complexa pelas dificuldades de se colocar em prática o que a legislação determina quanto à aplicabilidade dessas medidas. Assim, será abordada neste trabalho a discussão a respeito da eficácia da Internação de adolescentes no Distrito Federal.There was a great historical evolution of the rights of children and adolescents, what is clear in the Doctrine of Integral Protection brought by the Convention of Rights of the Child in 1989 and later adopted in Brazil, through the Law 8.069/1990 establishing the Statute of children and Adolescents. The statute gives the counting procedure in case of crime or misdemeanor committed by teenagers, and said to apply the so-called educational measures. Among the measures, the detention is applied to adolescents who had committed offenses with violence or serious threat to the person, or when the teenager failed, for reasons unwarranted, another previously imposed measure. This measurement is accomplished in an inpatient unit, where this young man, in theory, will have the support for his psychological structure to become a citizen able to completely build a satisfying career in your life, achieving their goals through the work, in coexistence with the family, if detaching completely from crime. The educational measures has as main objective the rehabilitation of the juvenile offender, ie, its output of life in crime. The rehabilitation becomes complicated by the difficulties of putting into practice what the law determines the applicability of these measures.
