Resumo: This work aims to evaluate the possibility oftransparency and publicity of state acts based on the framework of Niklas Luhmann’s Theory of Systems. With a point of departure in the concepts of transparency and publicity, the theme will be developed, with the subsequent presentation of the Luhmann’s theory. Having exposed these topics, the possibility will be determined of basing the need for transparency and publicity on the actions of the State organization according to Luhmann’s theory, justifying the respective presence in the social system. The study will be carried out from the bibliographical and documentary revision, using the inductive method, although the analysis has as its object the Systems Theory.
