Globalization, transnacionalism, and the effectiviness of human rigths

Resumo: The aim of this approach is to analyze the realization of human rights in a new order caused by the phenomenon of globalization and one of its main consequences, transnationalism. For this, the study begins with the demonstration of the consequences of these phenomena, to mention the reduction of borders between countries and the alteration of legitimating bases. Then, some important considerations are verified for the institute of human rights, especially its protection by the regional systems of protection, among them American, European and African. In the sequence and at the end, it is built from some practical examples and with a doctrinal basis, as has been given to the realization of human rights in this new scenario, especially with the outstanding and efficient performance of private actors with regard to the realization of these rights, A position previously expected mainly of states and never seen so effectively by transnational actors. The methodology used is normative and doctrinal research, while the method is the inductive one.

Para isso, o estudo inicia com a demonstração de consequências dos referidos fenômenos, a citar a diminuição de fronteiras entre países e a alteração de bases legitimadoras. Em seguida, faz-se a verificação de algumas considerações importantes para o instituto dos direitos humanos, em especial sua proteção pelos sistemas regionais de proteção, entre eles o Americano, Europeu e Africano. Na sequência e ao arremate constrói-se a partir de alguns exemplos práticos e com fundamentação doutrinária como tem se dado a efetivação de direitos humanos nesse novo cenário, em especial com a atuação destacada e eficiente de atores particulares no que tange à concretização desses direitos, postura antes esperada principalmente dos Estados e nunca vista com tanta eficiência através de atores transnacionais.
