THE HISTORICITY OF FUNDAMENTAL RIGHTS IN THE SCOPE OF THE EUROPEAN UNION

The purpose of this article is to analyze the historicity of fundamental rights within the European Union, showing how they were regulated by the community legal order during the integration phases. The research is justified not only by the practical and theoretical relevance, when dealing with an integration system that greatly influences the others, but also by the topicality of the theme that is still so little disseminated nationally. Using deductive and historical methods and bibliographical and documentary research, it was possible to answer the problem-question based on the hypothesis that prior to the publication of the Charter of Fundamental Rights of the European Union, the European Communities already recognized the importance of these rights and the need for regulation at the community level; although this was not the initial interest with integration, which with the search for greater economic integration, emphasized the need for legal and political integration.
