In 2013, a theme attracted a lot of attention from Brazilian Society and its political class: the Proposed Constitutional Amendment 37A, known as PEC 37. The dispute over the approval of defeat of the PEC involved broad sectors of civil society, members of the Public Ministry, representatives of the justice and security systems and reached unthinkable repercussions when it was incorporated in the agenda of the protesters of June of that year. Whit this observation on the horizon, the text now presented constructs a contextual panorama that led to the supposed need for this PEC, the debates held by Congress and the speeches of the various important entities and actors invited to express themselves on the subject, reflects on the history, consolidation and meanings of the concept of judicialization, from which we sought to understand the dispute involving that PEC.
