Resumo: The research on the Brazilian traffic safety is fundamental for raising awareness, not only of government, but throughout society, about the riskness of drinking alcohol and other substances while driving any motorized vehicle. This research consists in the analysis of the rightful and social effects of the Law n. 11.705/2008 , which maintains the rigidity of the traffic law to those who drive under the influence of alcohol or other psychoactive substances, trying to highlight the benefits of the law changes, always taking in consideration the huge importance of this law to society. Nevertheless, this analysis does not forget the inconsistencies that this norm presents, revealing their potential threats to juridical certainty and other very important constitutional principles. The mission of this work will be met when providing the reader the exact dimension of how the traffic laws about the use of toxic substances, can be applied in the least offensive way possible to the right , offering maximum benefit to society.

Este trabalho consiste na análise jurídica e social da Lei 11.705/2008, que cuida do enrijecimento da legislação de trânsito para aqueles que dirigem sob efeito do álcool ou outras substâncias psicoativas, procurando ressaltar e defender as alterações legislativas dignas de nota, levando-se sempre em conta a enorme importância desta Lei para a sociedade. Não obstante, essa análise não esquece as incongruências que tal norma apresenta, mostrando suas possíveis ameaças à segurança jurídica e também a outros importantíssimos princípios constitucionais.
