Resumo: The aim of this article is to answer the following question: does the public policy for community gardens in Maringá represent an adequate instrument for access to adequate food and an increase in the improvement of the social/economic condition of project recipients? It is believed that regular access to adequate food is a prerequisite for the dignified existence and realization of the person's personality rights, and the public policy of community gardens represents an important instrument for the provision of adequate food and, with the necessary course corrections, can become an effective instrument for improving life and access to income for those involved in the project. Thus, using a theoretical-legal methodology with deductive reasoning, through doctrinal analysis and also qualitative analysis of semi-structured questionnaires, applied to some representatives of a given sample of community gardens in Maringá, it was possible to try to achieve the objective of this article, that is, drawing a parallel between lack of food and social exclusion versus access to adequate food and the effectiveness of human and social development.

Para tanto, far-se-á uma análise da política pública das hortas comunitárias desenvolvidas no município de Maringá, PR, por meio da pesquisa de campo e aplicação de entrevistas e questionários, bem como visitação de três hortas específicas, onde serão colhidos dados concretos da execução e resultados da política pública em comento. O trabalho foi dividido em três partes: na primeira, apresentou-se a política pública das hortas comunitárias de Maringá e sua adequação aos fins constitucionais do direito social à alimentação adequada (art. 6º da CF/88); na segunda parte apresentar-se-ão os dados empíricos encontrados e; na última parte se fará uma sugestão de melhoria nos rumos da política pública. Através dessa análise, demonstrar-se que a política pública das hortas comunitárias representa importante instrumento para o fornecimento da alimentação adequada e, com as devidas correções de curso, pode se transformar em instrumento efetivo de melhoria de vida e acesso à renda dos envolvidos.
