The United Nations and the binding treaty on transnational companies and human rights: an analysis from social movements

Resumo: | The adoption of Resolution 26/9 in 2014, by the Human Rights Council of United Nations, changes the trend developed until now in that body; It establishs the debate on the need for binding rules against the logic of voluntaries codes. This article reviews the evolution of control instruments over transnational corporations and human rights in United Nation, from the perspective of human rights organizations, social movements, critical sectors of academia and affected communities. In turn, it analyzes the current mandate, which opens a process to create a binding instrument, also from the approach of these same actors. One of the main evaluations is that Resolution 26/9 is an opportunity to establish measures to stop the impunity of large corporations and, based on this consideration, have made concrete proposals for the elaboration of the binding instrument. Other important aspects to be emphasized in the analysis of the current context are the barriers that can restrain the binding instrument given the asymmetry in power relations between transnational corporations and social majorities. Based on the evaluation of both issues, they consider it essential to accompany the UN process and to bring forward the proposals generated collectively in the construction of a right "from below" to guarantee the fulfillment of human rights against the impacts of the transnational companies. |

El presente artículo revisa la evolución de los mecanismos de control sobre empresas transnacionales y derechos humanos en las Naciones Unidas desde la perspectiva de las organizaciones de derechos humanos, movimientos sociales, sectores críticos de la academia y comunidades afectadas. A su vez, analiza el actual mandato, por el cual se abre un proceso para crear un instrumento vinculante, también desde el enfoque de estos mismos actores. Una de las principales evaluaciones es que la Resolución 26/9 es una oportunidad para establecer medidas que frenen la impunidad de las grandes corporaciones y, en base a esta consideración, han realizado propuestas concretas para la elaboración del instrumento vinculante. Otros aspectos importantes a resaltar del análisis del actual contexto son las barreras que pueden frenar el instrumento vinculante, dada la asimetría en las relaciones de poder entre las empresas transnacionales y las mayorías sociales. A partir de la evaluación de ambas cuestiones, consideran fundamental acompañar el proceso de la ONU y hacer llegar las propuestas generadas de forma colectiva en la construcción de un derecho “desde abajo” para garantizar el cumplimiento de los derechos humanos frente a los impactos de las empresas transnacionales.A aprovação da Resolução 26/9 no ano de 2014 por parte do Conselho de Direitos Humanos das Nações Unidas troca a tendencia que até então estava desenvolvendo-se em tal organismo; establece o debate sobre a necessidade de normas vinculantes frente à lógica da voluntariedade. O presente artigo revisa a evolução dos mecanismos de controle sobre empresas transnacionais e direitos humanos nas Nações Unidas a partir da perspectiva das organizações de direitos humanos, movimentos sociais, setores críticos da academia e comunidades afetadas. Por sua vez, analisa o atual mandato, pelo qual se abre um proceso para criar um instrumento vinculante, também a partir da perspectiva desses mesmos atores. Uma das principais avaliações é de que a Resolução 26/9 é uma oportunidade para establecer medidas que freiem a impunidade das grandes corporações e, com base nesta consideração, tenham realizado propostas concretas para a elaboração do instrumento vinculante. Outros aspectos importantes a ressaltar da análise do atual contexto são as barreiras que podem freiar o instrumento vinculante, dada a assimetria nas relações de poder entre as empresas transnacionais e as maiorias sociais.
