Resumo: Esta pesquisa propõe analisar se o cumprimento do comando legal do Estatuto da Criança e do Adolescente (BRASIL, 1990), alterado pela Lei n. 12.010 (BRASIL, 2009), que determina a prevalência da família natural e o esgotamento das tentativas de manutenção ou reintegração da criança e/ou adolescente junto a esta entidade familiar, obstaculiza a concretização de adoções, colide com o princípio do melhor interesse da criança e, consequentemente, viola direitos fundamentais dos infantes. Diante disso, pretende-se analisar o entendimento dos doutrinadores através da literatura sobre o tema, os dispositivos legais que determinam a ordem de preferência familiar, a coleta de dados e estatísticas, e algumas decisões judiciais referentes ao assunto. A hipótese levantada é a de que o estrito cumprimento da ordem que privilegia a família natural, se não ponderada com o princípio do melhor interesse da criança, gera prejuízos aos infantes, limitando-os de serem inseridos em família substituta na modalidade de adoção e gozar de seus direitos fundamentais.

In view of this, it is intended to analyze the understanding of scholars through the literature on the subject, the legal provisions that determine the order of family preference, the collection of data and statistics and some judicial decisions regarding the subject.
