Resumo: O presente trabalho pretende analisar a construção normativa acerca do sequestro internacional de crianças por meio convenção de Haia de 1980 com intersecção ao fenômeno da violência doméstica. Assim, evidenciando a necessidade de uma interpretação mais ampla das exceções previstas ao imediato retorno da criança ao país do genitor e uma atualização da lei toda para preencher as lacunas existentes. Além de contrapor a convenção de Haia, com a Lei Maria da Penha e a Convenção Interamericana sobre os Direitos Humanos, que garantem a proteção da mãe que é vítima de violência doméstica. Foi utilizado a pesquisa de maneira qualitativa, com a junção de uma investigação exploratória, com análise documental, um modelo dedutivo, utilização de doutrina especializada e estudo de casos para ilustrar a problemática do objeto do projeto.

Thus, highlighting the need for a broader interpretation of the exceptions provided for the immediate return of the child to the genitor’ country and an update of the whole law to fill the existing gaps. In addition to comparing the Hague Convention with the Maria da Penha Law and the Inter-American Convention on Human Rights, which guarantee the protection of mothers who are victims of domestic violence.
