U.K. 1998 Human Rights Act. AbstractThis article intends to resume the debate between judicial review and legislative supremacy. Both suffer heavy criticism and can be pointed out that while the scheme of supremacy of the legislature has shown itself historically incapable of protecting minorities from casual majorities, the judicial review, widely prevalent in most countries today, is questioned about the democratic legitimacy of their judgments. Across these two models, arises, in the UK, in 1998, a third party willing to take the vicissitudes of each, increasing its positives and negatives equalizing. This system adopted by the United Kingdom will be reviewed in this article in order to demonstrate the contextual constraints that prevent their application to the brazilian reality.KEYWORDS: Judicial Review and Legislative Supremacy. Constitutionalization of Fundamental Rights. U.K. Human Rights Act 1998. |
